Social Regulation

Pursuant to the National Policy Objectives set out in the Communications and Multimedia Act 1998, the Malaysian Communication and Multimedia Commission is entrusted with the responsibility to "grow and nurture local information recourses and cultural representation that facilitate the national identity and global diversity. To that end, the Malaysian Communication and Multimedia Commission designated the Content Forum on 28 February 2001.

However the Malaysian Communication and Multimedia Commission continues to:

  1. To monitor compliance with content standards and codes by Content Applications Service Providers (CASP) and relevant Application Services Providers (ASP) including Broadcasters, Advertising Content, Audiotext, Online Operators etc.
  2. To provide industry benchmarks on content standards and practices.
  3. To provide input and recommendation on any matter concerning the social regulation of the communications and multimedia industry, including but not limited to:
    • industry policies
    • codes and guidelines
    • standards, regulations
    • licence conditions etc.
  4. To monitor, evaluate and report on the impact Content Applications Service Providers / Application Services Providers, public concerns about standards and effectiveness of content policies, codes and standards.
  5. To address and respond to any complaints regarding "networked" content i.e. Broadcasting, Advertisements, Audiotext, Online, Closed Content, etc.
  6. To create public awareness and provide education on content policies, codes and standards.
  7. To assist the Content Forum in the implementation of its various programs and to review, propose and recommend changes in policy and/or codes by Content Forum
  8. To advise on issues concerning Section 211 and 233 of the Communications and Multimedia Act 1998
  9. To render assistance and to promote cooperation and coordination amongst service providers and/or regulatory authorities.

Section 211 of the Communications and Multimedia Act 1998 provides:

"No content applications service provider, or other person using a content applications service, shall provide content which is indecent, obscene, false, menacing, or offensive in character with intent to annoy, abuse, threaten or harass any person."

The Malaysian Communication and Multimedia Commission works with various bodies including the Ministry of Information, Communications and Culture (MICC), Ministry of Information (MoI), Ministry of Home Affairs (MoHA), Ministry of Health (MoH), the Censorship Board (under the purview of MoHA), the Content Forum, and FINAS.
