Introduction

Under the Communications and Multimedia Act 1998 instruments can be issued by the Minister in the form of a Direction, Determination or Declaration, or by the Commission in the form of a Direction or Determination. The Minister may also issue a Direction under the Malaysian Communications and Multimedia Commission Act 1998.

Ministerial Directions are issued to the Malaysian Communications and Multimedia Commission on the exercise of the Malaysian Communications and Multimedia Commission's powers and the performance of the Malaysian Communications and Multimedia Commission's functions and duties under the Communications and Multimedia Act 1998, whether of general character or otherwise.

The Minister may issue a Ministerial Determination on any matter specified in the Communications and Multimedia Act 1998 as being subject to Ministerial Determination without consultation with any licensees or persons.

The Minister may also make a Ministerial Declaration that an individual licence, or a class of individual licence, or a class licence is subject to such conditions or enjoys such benefits, as the Minister deems fit.

Malaysian Communications and Multimedia Commission's Directions empowered to write to any person regarding the compliance or non-compliance of any license conditions, and including but not limited to the remedy of a breach of a licence condition, and the provisions of the Communications and Multimedia Act 1998 and its subsidiary legislation.

The Malaysian Communications and Multimedia Commission may determine any matter specified in the Communications and Multimedia Act 1998 as being subject to the Malaysian Communications and Multimedia Commission's determination.
