Background
 
Innovation process involves research, development, trial and related activities. In promoting and facilitating this process, Malaysian Communications and Multimedia Commission (MCMC) may provide some regulatory flexibility (e.g. usage of non-standard apparatus, equipment or device; from licensing and quality of service requirement) and temporary usage of spectrum, subject to an approval on a case-by-case basis, through the TED application process.
 
The Guidelines for Trial, Experiment and Demonstration lays down the general procedures for reference in which a TED approval can be obtained.
 
Scope
 
The approval for TED is required only if the activities fall within the regulatory purview of MCMC, under the Communications and Multimedia Act 1998 and its subsidiary legislations. The approval may include the usage of spectrum, non-standard communications apparatus, equipment, or devices, as well as the authorization to perform the activities.
  
As a guidance, the following types of activities may NOT fall within the scope of TED:
 
  1. Use of certified apparatus, equipment or device where there would be no concerns on interference, safety, security and interoperability;
  2. Does not involve the use of spectrum where there could be concerns on interference, safety, security and interoperability issues;
  3. Where there is no regulatory flexibility or assistance required (e.g. by a valid license / assignment holder, where the activities are within the scope of the rights conferred by the license / assignment);
  4. Involving only pure commercial matters (i.e. non-technical) within applicant’s own business risk assessment and consideration; and
  5. Does not involve the provision of service to end user where there could be concerns on customers’ protection and network / data security.
Eligibility
 
Any person or entity, whether local or foreign, who has a reasonable purpose to conduct the TED activities in Malaysia can apply to MCMC via TED application process. This includes licensees, potential licensees, consultants, commercial / academic researchers, developers, and fabricators / manufacturers.
 
Please note that for a foreign person or entity, it is required to have a local office or appoint a local authorised representative to apply.

TED Application
 
For the TED application, applicant is required to submit the application through the Technical Standards System (TSS). Please refer to User Manual for TSS for guidance.
